GENERAL PURCHASE CONDITIONS

  1. INTRODUCTION

This contractual document establishes the conditions of the purchase of products through the website www.3claveles.com, owned by BUENO HERMANOS, S.A.

We ask you to read these General Purchase Conditions and our Privacy Policy and Cookies Policy carefully before using this website. By using this website or placing an order through it, you agree to be bound by these Terms and Conditions and by our Privacy and Cookies Policy, therefore, if you do not agree with all the Terms and Conditions and the Privacy Policy and Cookies, you should not use this website.

The acceptance of this document implies that the buyer:

  • You've read, you understand and you're agree with this text.
  • You are a person over 18 years of age with legal capacity to contract.
  • You assume all the obligations set forth herein.

Orders may only be placed to purchase non-resale merchandise. Any resale or distribution of products purchased through the website is strictly forbidden.

We reserve the right to be able to cancel fraudulent, false or speculative orders, as well as those orders that have been requested by a client with whom there may be a difference/controversy in previous orders, or when there are reasonable doubts that may make us think that the customer is infringing any of the specified purchase conditions or is participating in any criminal activity.

These conditions will be valid for an indefinite period of time and will be applicable to all contracts made through the Bueno Hermanos, S.A. website.

Bueno Hermanos, S.A. reserves the right to unilaterally modify the conditions, without affecting the goods or promotions that were acquired before the modification.

  1. CONTRACTING PARTIES

On the one hand, BUENO HERMANOS S.A. with NIF A26004614, address at P.I. Cantabria I, C/ Barrigüelo, 6 26009 Logroño (La Rioja), NIF A26004614 and email info@buenohermanos.com.

And on the other, the buyer, registered on the website www.3claveles.com through a username and password, over which you have full responsibility for use and custody.

The buyer is required to provide Bueno Hermanos, SA with all the data necessary for accessing and using the services on this website. These must be true and current and you agree that we can use them to contact you if necessary.

It is essential that you provide all the information that we classify as mandatory, since otherwise we will not be able to process your order. We will not be responsible in any case for possible delays or failures in delivery as a result of the error or omission of this data.

  1. OBJECT OF THE PURCHASE CONDITIONS

These purchase conditions are intended to regulate the purchase by the buyer of any of the products offered by Bueno Hermanos on its website www.3claveles.com according to the conditions published at the time of purchase.

  1. CONDITIONS APPLICABLE TO ORDERS

The products offered through this website are only available for shipment to the Peninsula and the Balearic Islands in Spain.

If you wish to place an order from another country through this website, you can do so, however, keep in mind that we only offer deliveries to an address in Spain, except the Canary Islands, Ceuta and Melilla.

4.1 HOW TO PLACE AN ORDER

To place an order, you can browse the website until you find the desired product. Once located, clicking on it will access all the detailed information offered by the website. From there you can add the product to your basket.

If this is the first time you buy with us, you will be asked to register by entering your email address and a password with which you will be able to create your account.

If you are already registered with an active account, you must enter your email and password, and the system will recognize your data.

From your account you can continue the purchase and finally confirm the order.

Once you accept the purchase conditions and place the order, it will be considered accepted. Subsequently, you will receive an email acknowledging receipt of your order, formalizing the contract between you and us at the time of placing the order.

Orders will be shipped from Monday to Friday working days. Orders processed during the weekend will be processed the next business day.

If you wish to receive your invoice, you must request it at the time of placing the order.

4.2 AVAILABILITY OF PRODUCTS

All orders are subject to product availability. If there are difficulties in the supply of products or if there are no items in stock, we will inform you as soon as possible by email or telephone, and we will refund any amount you may have paid.

4.3 DATA, CONFIRMATION AND CANCELLATION OF ORDERS

If you detect you have made a mistake when entering your personal data during your registration as a user of this website, you can modify them in the "My Account" section.

Before completing the order on the website, you will be able to review all the details, being able to correct if necessary.

After confirmation it will not be possible to modify or cancel the order via the website, you must contact us. In this case, the order can only be canceled if the item has not been dispatches from our warehouses.

4.4 PRICE AND PAYMENT

The prices on this website are shown in euros and include VAT in force in Spanish territory except the Canary Islands, Ceuta and Melilla, but exclude shipping costs, which will be added to the total amount. The applicable rate will be the one legally in force at all times.

Bueno Hermanos, S.A. will only ship to Spain (except the Canary Islands, Ceuta and Melilla).

Only orders for which payment has been completed and verified will be processed.

Payment must be made by credit card (VISA and MASTERCARD) and PayPal.

Credit card, through a payment gateway (Virtual POS): the buyer and purchase data will be entered and transmitted directly by the buyer to the entity that owns the gateway. These data will not be stored or manipulated by us, but will be registered directly in the payment gateway of the corresponding financial institution. The amount of the order will be charged to your card, so you must indicate the number, the expiration date, as well as the security code CW2 (on the back of your card). If your card is secured, you will be asked for the relevant security codes. The buyer can pay for his order through the bank gateway.

The charge will be carried out in real time through this payment gateway. If the charge cannot be carried out finally (for any reason), the order will be automatically cancelled.

PayPal: the buyer must be previously registered and be a PayPal user. To make the payment, identification as a PayPal user will be requested, either to pay with your credit card, or to pay with your PayPal balance.

4.5 DISCOUNT CODES

Promotional codes may be offered from time to time.

The conditions of use related to any discount code will be specified at the time of issuance. However, these terms and conditions apply to all promotions, contests and discount codes of our company (unless otherwise stated):
- Only one promotional code can be used per order.

- A promotional code cannot be used after an order has been placed.

4.6 DELIVERY OF ORDERS

Bueno Hermanos, S.A. will only ship to Spain (except the Canary Islands, Ceuta and Melilla). Orders will be sent from Monday to Friday through Correos Express within their normal business hours.

Shipping costs are free for orders over €50 (VAT included).

In the case of orders under €50, the shipping costs will be €5 for national shipments to the Peninsula and €15 to the Balearic Islands.

Delivery times are computed on working days from Monday to Friday, since the courier company does not deliver on Saturdays, Sundays or holidays.

The usual delivery time will be approximately 48 h. in the Peninsula and 72 h. in the Balearic Islands This term may increase in sales periods, Christmas campaigns or other circumstances derived from geographical distance, weather conditions, wars, strikes, any form of government intervention, breaches by our suppliers, etc. as well as any other attributable to the logistics operator in charge of delivering the product. We are not responsible for possible delays that may be caused by any of the reasons mentioned above.

If, at the time of delivery, the packaging of the order is damaged, you must open the package in the presence of the carrier to verify the condition of the items. If damage is observed, you must detail it on the delivery note and contact us within 24 hours. We will repair or replace at no cost to you all those items that have been damaged or lost during transport, as long as you notify us of the incident as soon as possible.

Once the order has been delivered, it will become part of your property and therefore, all damages that may arise will be your responsibility.

4.7 RETURN POLICY

4.7.1 Right of withdrawal

You may exercise the right to withdraw from this contract within a period of 14 calendar days without the need for justification.

The withdrawal period will expire 14 calendar days from the day you or a third person indicated by you, other than the carrier, received the merchandise.

To exercise the right of withdrawal regarding products purchased exclusively at www.3claveles.com, you must notify us by means of an unequivocal declaration that you will have to send us by one of the following means:

- By postal mail to the address BUENO HERMANOS, S.A. P.I. Cantabria I, C/ Barrigüelo, 6 26009 Logroño (La Rioja), Spain.

- By email to the address info@buenohermanos.com.

You can use the model withdrawal form that appears as an Annex to these Conditions, although its use is not mandatory.

To comply with the withdrawal period, it is enough that the communication regarding the exercise by you of this right is sent before the corresponding period expires.

4.7.2 Consequences of withdrawal

In the event that you exercise the right of withdrawal, we will return to the buyer all payments received after the purchase, including delivery costs (with the exception of additional costs derived from it) without undue delay and, in any case, before that 14 calendar days have elapsed from the date on which we were informed of the withdrawal decision.

We may withhold reimbursement until we have received the products, or until the customer has provided proof of return of the products.

The amounts refunded will be paid by the same means of payment that was used in the purchase without incurring any expense as a result of the refund, except for the cost of returning the product.

The produscts must be returned in identical conditions to those in which they were delivered, with all their containers and packaging.

In order for the product on which the right of withdrawal is exercised to be accepted, it must be correctly protected, in its original packaging, in perfect condition for subsequent sale and keeping its labeling.

The amount of shipping costs in case of return is not returned and is the responsibility of the buyer.

4.7.3 Returns

In case ypu receive the order with damages caused during transport, it is important that you take some photographs of the the damages to support a possible claim with the transport agency, and you must note it on the delivery note that you sign to the delivery person. You have 24 hours to claim this incident. If when you receive the package, you do not see any damage because the box is closed, you also have 24 hours to inform us of the claim. 

If you receive a damaged or defective product, please take photos and contact our Customer Service to request its replacement.

If you receive an erroneous product, you have 7 calendar days to make the claim.

All return costs are borne by Bueno Hermanos, S.A. as long as the reason is attributable to the company. This case is considered whenever there are production defects, warehouse errors or they have been damaged during transport.

4.7.4 Warranty

It is expressly informed that, if you contract as a consumer and user, we offer guarantees on the products that we sell via this website, in the terms legally established for each product, against any defect in materials or manufacturing under normal conditions of use that appear within a period of three years from the delivery of the product. Deficiencies caused by normal wear and tear or misuse of the product are not included.

4.7.5 Dispute resolution

In compliance with article 14.1 of Regulation 524/2013 regarding dispute resolution, we inform you that you can go to the ODR Platform for online dispute resolution: https://ec.europa.eu/consumers/odr/

  1. APPLICABLE LAW AND JURISDICTION

The relationship between Bueno Hermanos, S.A. and the buyer will be regilated by Spanish law.

Any controversy that arises or is related to the use or contracting via the website will be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.

When the contract is made as a consumer, nothing in this clause will affect the rights recognized by current legislation.

In those cases in which the buyer does not have the status of consumer or user, or who is domiciled outside of Spain, they will submit to the Courts and Tribunals of Logroño, expressly waiving any other jurisdiction that may correspond to them.
